1. General provisions

Please read carefully the following provisions of these Terms of Use. This document establishes the general terms and conditions of use of Vibely, legally binding for all users accessing or using Vibely by any means.

These Terms of Use apply to your access and use of Vibely. By accessing or using the site, you agree to be bound by these Terms of Use. If you do not agree to these terms and conditions, please do not use this site.

BY USING THE WEBSITE, YOU AGREE TO THESE TERMS. PLEASE READ CAREFULLY.

2. Definitions

  1. «Vibely» — our website, including access via its public URL;
  2. «Content» — any material uploaded to Vibely by any User (whether Creator or Subscriber), including photos, videos, audio, text, metadata, images, interactive features, emoticons and any other materials;
  3. «Creator» — a User who has set up their Vibely account to publish Content for other Users to view;
  4. «Subscriber» — a User who is subscribed to a Creator and/or can view the Creator's Content;
  5. «Subscriber/Creator Transaction» — any transaction between a Subscriber and a Creator on Vibely which provides access to the Creator's Content, including subscriptions, paid messages, tips and pay-per-view payments;
  6. «Subscriber Payment» — any and all payments made by the Subscriber to the Creator;
  7. «Subscription» — a Subscriber's subscription to a Creator's account or to a certain type of the Creator's content (paid or free);
  8. «User» — any Vibely user, whether Creator, Subscriber, or both.

3. Changes to the Terms

We may change any part of these Terms without prior notice, in particular to reflect changes in laws and regulatory requirements, or to eliminate unforeseen and imminent dangers related to protecting Vibely, Creators or Subscribers from fraud, malware, spam, data leakage or other cybersecurity risks.

As soon as any updated Terms take effect, you will be required to comply with them if you continue to use Vibely.

We can update and change Vibely for any reason, as well as change its design, content and functionality, modify or supplement the services offered.

4. Age restriction

Vibely is intended strictly for persons who have reached the age of 18 or the age of majority in their jurisdiction, whichever is higher. By using Vibely you confirm that you meet this requirement.

If you do not meet the age requirement, access to and use of Vibely is prohibited.

5. Accounts and verification

To publish Content and receive payments, a Creator must complete identity verification. We may request documents confirming your identity and age.

You are responsible for the confidentiality of your account credentials and for all activity that occurs under your account.

We may suspend or terminate accounts that violate these Terms, applicable law, or the rights of other Users.

6. Content rules

You retain ownership of the Content you upload. By uploading Content you grant Vibely a non-exclusive license to store, display and distribute it within the platform for the purpose of providing the service.

It is prohibited to upload Content that is illegal, infringes intellectual property rights, depicts minors, involves coercion or human trafficking, or violates the rights and dignity of any person.

We reserve the right to remove any Content that violates these rules without prior notice.

7. Payments and payouts

Creators receive the revenue share displayed in their account dashboard from Subscriber Payments. Vibely deducts a platform commission before payout.

Payouts are made to the payment details provided by the Creator, subject to successful verification and applicable law.

Subscriber Payments are final except where a refund is required by law or by the rules of the payment provider.

8. Limitation of liability

Vibely is provided «as is». We do not guarantee uninterrupted operation of the platform and are not liable for losses arising from the use or inability to use the service, to the extent permitted by law.

Creators are solely responsible for the Content they publish and for complying with the laws of their jurisdiction, including tax obligations.
